Aditi Bansal & Aviral Jain, O.P. Jindal Global University

ABSTRACT

This paper focuses on how can the culture and traditions change the laws prevalent in the land especially engaging with the inheritance laws. And whether or not can the culture and traditions of a particular country be brought up by its laws. Focusing on the south Asian countries as a focal point to compare with the other European and American countries, it can be pointed that the Asian countries use their culture and traditions as a backbone to the laws. Asian countries are much diverse in nature in terms of regions and caste. And thus it is important for such countries to make sure that all of the diverse religions are comfortable with the laws.

Inheritance is a topic which has been in there since the ancient times. This therefore must be an important part of the tradition and thus people can be much more attached to the way they want to distribute their property. Inheritance is an important family subject which makes the laws to be made over it much harder to be formed. We would look at how the south Asian countries and other European and American countries have inbuilt their culture as a part of their laws and how do all of these laws differ due the basis of culture and tradition.
