Information And Privacy: A Comparative Legal Analysis With Implications For India

ABSTRACT


Genetics, the scientific study of genes and heredity, has evolved to offer profound insights into Genetic human biology, revealing everything from physical traits to predispositions for various diseases. However, the rapid advancements in genetic testing and data collection have raised significant concerns regarding the privacy and misuse of genetic information. This paper explores the importance of genetic privacy, examining the current legal landscape in India and abroad. It identifies critical gaps in India's approach to genetic data protection, emphasizing the need for specific laws to safeguard individuals' genetic privacy. The analysis includes a comparison with established frameworks such as the Genetic Information Non- Discrimination Act (GINA) and the Health Insurance Portability and Accountability Act (HIPAA) in the United States. The study concludes by recommending the introduction of robust genetic privacy laws in India to prevent misuse and ensure that genetic information is used ethically and responsibly.
