Inertia of Criminal Justice Mechanism

ABSTRACT


Every human being is a social animal i.e., he requires a society to live in but as a society is formed, problems start to rise. Differences of opinions being to happen. These differences of opinions give way to ego clashes which further take an edge to fall under the pigeonhole of crime, serious or petty as the case may be. Every society small or large, has its own mechanism to deal with such crimes and criminals. However, the primary categories are the adversarial and inquisitorial system of criminal justice mechanisms. While the former is generally followed by the common law countries, the latter is followed by the civil or Roman law countries. This paper focuses on the complete inertia of criminal justice mechanisms in both kinds of criminal justice systems. The author has attempted to cover all the aspects of adversarial and inquisitorial criminal justice mechanisms including the principle it is founded upon, their working, advantages and disadvantages.
