ABSTRACT
This article undertakes a critical assessment of the statutory regime in India pertaining to the administration of electronic waste, or "e-waste," management. This analysis traces the development of pertinent legislation, encompassing the Environment (Protection) Act of 19861., and the subsequent promulgation of the E-Waste (Management) Rules. The analysis dissects the legal architecture for the collection, treatment, and disposal of electronic waste., identifying both strengths and weaknesses in the current regime. The chapter further explores the effectiveness of enforcement mechanisms and the role of extended producer responsibility (EPR) in incentivizing responsible e-waste management practices. In conclusion, the article offers a cogent assessment of the legislative framework, highlighting areas for potential reform to ensure a more robust and environmentally sound Indian Legal and Policy Infrastructure for E-Waste Management.
