Implications Of E-Contracts: Glimpse Into The Spotify User Agreement

INTRODUCTION

India being a fast-developing nation, interacts with innovations to lifestyle on a frequent basis. With the advent of globalisation, coupled with breakthrough technological advancements, digitization deems to be the efficient way forward. In this era, the number of internet users multiply quickly in a short span of time. There is massive penetration of E-Commerce worldwide. This renders countless benefits to customers, but at the same time it results in numerous legal challenges. And so, the legal field too is experiencing a revolutionary change in dynamics, to be more adjusting towards the digital era.

The very essential of every professional commitment is a Contract. To be legally binding and enforceable to both the parties, contracts are formulated. However, in my opinion, restricting contracts to the traditional sense of their being will not yield a significant outcome, owing to the globalised structure of commerce. We need to look beyond this limitation and incorporate the need of the hour – Electronic Contracts, the new form of contracting – for a smooth functionality. Thus, in this response paper, I attempt to analyse the implications of E-Contracts, the conditions of E-Commerce pertaining to the user agreements and the legal challenges posed by the digital mode of communication.
