Abstract

Workplace harassment is a grave issue in our society. An act or instance of harassing that trouble or annoy the other person who often covers a wide range including sexually or mentally. But when we talk about harassment it only means harassing someone sexually? Well it’s not just the case of harassing someone sexually. It has wide range of behaviours which include almost every aspect. In this research paper, the researcher will talk about each and every aspect which will throw light on the ongoing behaviour of harassing. Or better to say the threatening behaviour which affects the entire society. Vishakha vs. State of Rajasthan is the landmark judgment which deals with the sufferings of a woman at workplace and also the discrimination which highly prevails in the society. It also talks about the unsafe environment for the women to step out of their residents and work as if becoming independent or working for a better future is crime for the other section of the society. The only difference from the time of Bhanwari Devi to till date is the increased number of cases on harassment on the various degrees whether sexually, mentally, or at workplace. The researcher will talk about each and every aspect and also how it affects our entire society and how it is affecting the mental health of a person. This is something which is highly unnoticed or untouched subject in the society upon which no one wants to talk, no one wants to understand how it affects the live of victim and how it led to several sufferings. In fact, history has also experienced it in the case of Draupadi. Supreme Court has given a landmark judgment in which fundamental rights of a women and creating safe workplace harassment came into existence. But are we really working in a safe environment? Big questions mark because the truth about the safety and better environment will shake every one of us. It seems this is a never-ending issue and the society has accepted it and start living with the fact.
