1. Introduction
The study and investigation of criminal law has always been one of the most alluring areas of jurisprudence since the dawn of human civilization, despite the fact that crime is viewed with the greatest hatred by all segments of society. Criminal law has actually been around for as long as civilization. Everywhere people have congregated or established groups, there has always been a need for laws and norms to regulate the conduct of the society as a whole. When society has set norms, it is impossible to avoid breaching them, hence methods for preventing these community tendencies that lead to rule infractions must be developed. Every organized society has laws that prohibit certain behaviors under threat of penalty. For example, if someone hurts another and the harm may be sufficiently repaired with money, the offender must pay damages or compensation to the victim.
However, in some instances, the State imposes penalties on the wrongdoer in addition to the obligation to provide compensation. This is done in an effort to maintain social harmony and encourage good behaviour towards one another and the community as a whole. The issue, though, is which behaviours should be prohibited, or which ones should be chosen for punishment by the state's society.
Public opinion has always influenced the idea of crime. The public itself establishes the boundaries between what constitutes a crime and what does not. The ancient texts also provide a specific definition of crime. Since the two topics of crime and law are so closely intertwined that it is impossible to understand one without understanding the other, we must first understand what law is in order to understand the nature and content of the crime, as we already know that law is a reflection of public opinion. The totality of laws established by men as political superiors or sovereigns over other men as political subjects is known as law. Law is a command enjoining a course of conduct to be observed by all the members of society and is backed by a sanction.
