Sai Lakshmi. S, VIT Chennai

ABSTRACT

India has always been a patriarchal society and women were considered rather put to be dependent on men. With the coming-of-age ideologies over the course of decades and their varied interpretations, the concept of women having and holding property has undergone certain fundamental modifications which act as mechanisms to deliver them the benefactors. The passing of this Act can be understood as synonymous with The Right of the Widow to succession. This was the earliest legislative piece that provided for the right of the widow upon intestate succession.

Keywords: property, patriarchy, widow, intestate succession, gender equality, stridhan, coparcenary, inheritance, limited interest.
