ABSTRACT

This research paper delves into the concept of dying declarations as an exception to the hearsay rule in India. It explores the legal framework surrounding dying declarations, examines their admissibility, and analyzes the rationale behind treating such statements as an exception to the general rule against hearsay evidence. Furthermore, this paper discusses the significance of dying declarations in ensuring justice and fairness in criminal trials, while also addressing the various challenges and criticisms associated with their admissibility. The research concludes by emphasizing the importance of careful evaluation and scrutiny of dying declarations to maintain a balance between the interests of justice and the rights of the accused.
