Guidelines For Arrest: Arnesh Kumar Vs. State Of Bihar & Anr. 2014 SC

Introduction

Arnesh Kumar vs. State of Bihar, commonly known as the case which gave the guidelines for arrest which are applicable to offences with imprisonment of less than 7 years, is a landmark judgement, given by the Division Bench of Supreme Court. The bench was headed by Justices Chandramauli Kumar Prasad and Pinaki Chandra Ghose. The appellant and respondents are Arnesh Kumar and State of Bihar & Anr. respectively, in this case. The judgement as aforementioned, was delivered on 2nd July 2014.

The essentials for filing a case under section 498-A of the Indian Penal Code are:

  1. Woman must be married

  2. Women is subjected to cruelty or harassment

  3. Such cruelty and harassment must
