Geographical Indication In Relation To Trips Agreement: An Evaluation Study

ABSTRACT

Geographical indications is actually an indication which is given to a set of people residing in that particular locality so that all the people living in the same will be having an edge over the distinctiveness of the product which was originally originated there. It is more like a tool of marketing which brings more value to the product originated and it should be a differentiation product. When there is a right which is available in one jurisdiction or registered under one terminal then it is completely restricted to that area or jurisdiction and not beyond that. It was recognized as the private rights by restricting others from putting employment into that so that the association which the original producers invested is not lost.

Geographical location is given to group people residing in that particular jurisdiction and they restrict people and some other from exercising the indication so that the rights envisaged are protected and are in course. So in this project the researcher would like to analyze various issues in respect to rights associated with people who live in that geographical area do they really hold monopoly or are those people rights well protected. So it is a matter of monopoly or not. And analyzing the intent and creation of the provision clearly so that do they really make positive sense out of it or is it being done to avoid the competition.
