Gender Inequality In The Hindu Law: Uniform Civil Code As An Alternative

ABSTRACT

India is, on paper, a secular state and it does not trouble itself with religious dogma but the Indian Constitution has provisions that allow the personal laws to operate within the four corners of the Constitution. The Constitution entails Articles 25 to 28 as freedom of religion.This paper attempts to look at the Uniform Civil Code as an alternative to the Hindu personal laws with specific reference to the laws that regulate social affairs such as marriage, adoption, and succession and how the Uniform Civil Code strives to rid the Hindu law of certain ambiguities and absurdities, at the same time striving to further the fight for gender equality and the fight against discrimination. This paper also acknowledges the obstacles that deter the implementation of the said Code.
