Gender Equality In Employment Avenues

ABSTRACT

Equality is a much cherished fundamental right. Gender equality is an important facet that has been debated over years. Gender equality means ensuring equal treatment of all genders including women and transgender persons in all spheres of life. Equality in workplace or job avenues is one such sphere. Women and transgender persons have faced discrimination in employment avenues when it comes to issues like the eligibility criterion for selection to certain jobs, the marital status for continuing in some jobs, the remuneration being lower than men, difficulty in finding jobs due to late working hours etc. The judiciary has however always acted as the sentinel on the qui vive to protect the rights of women and transgender persons as well as ensure equality to them imbibing the true spirit of Constitution. This paper looks into the key issues faced by women and transgender persons in employment avenues and how the judiciary has made prompt interventions to mitigate the menace of discrimination through landmark and path breaking decisions.
