Gay Rights In India And USA: A Comparative Study

ABSTRACT

Gay rights are one of the most controversial issues in the world. The inhumane treatment and discrimination of individuals with different sexual orientations go way back to centuries. The last few decades saw significant changes in the movement and the perception towards the homosexuals changed a lot. A lot of nations are now progressive enough to accept and accommodate the homosexual community. The United States of America and many other European nations even have civil laws protecting gay rights and gay individuals. While a lot of progress has been made, there are still large parts of the world that criminalize and demonize the act of homosexuality. There are nations that penalize homosexuality with the death sentence. Thus, we have a long way to go in gay rights even now, starting from changing the perception and mindset of people to eradicating homophobia.

This article deals with the gay rights movement in India and The United States of America. A comparative analysis and study on the history, laws and judicial precedents both countries have for homosexuality. This analysis is important as there’s a lot India can learn from the gay rights development in the United States of America. India only recently decriminalized homosexuality and it’s important that the nation needs to look out for international examples on further development. Thus, this work will discuss the legal and social developments in gay rights in the United States of America and India.
