From The Decree To The Relief In Partition Suits Of Agricultural Properties In Maharashtra

ABSTRACT

The present article examines the procedure for obtaining the actual and physical possession of agricultural properties in Maharashtra, once the suit for partition has been decided.

Introduction:

A suit for partition may be filed by co-parceners or co-owners of a suit property. Suit properties may be a plot of land, a bungalow or a flat. A litigant in a suit for partition looks forward to receiving the actual and physical possession of his share in the suit property.

Based upon the rival pleadings, evidence led by the parties, a Court passes a decree. Typically, in a suit for partition, the entitlement or rights or shares of the parties to the suit are decided in a Preliminary Decree and upon execution of the same, the suit property is physically divided/partitioned by metes and bounds and the parties to the suit are put in actual and physical possession of their respective shares.
