From Sowing To Seeking Justice: Legal Remedies For Inferior Quality Of Seeds. A Legal Analysis Under The Consumer Protection Act

ABSTRACT


"Cotton, often hailed as 'white gold', has been a foundation of both agriculture and industry. Its enduring influence on human civilization highlights its unmatched value as the leading apparel fiber throughout history." Gujarat is the largest cotton-production State in India. In Gujarat, the soil suitable for cotton cultivation ranges from the sandy terrain of Kutch to the alluvial soils of Ahmedabad and Kheda districts, and the black cotton soils of Central and Southern Saurashtra. The region experiences moderate rainfall, typically between 50 to 125 cm, while temperatures during the crop's growth period can reach between 38°C and 41°C. The failure of cotton crop cultivation due to inferior-quality seeds presents a serious concern for farmers who invest heavily in agricultural inputs based on the trust built by sellers and manufacturers. This article examines a real-world case from District Surendranagar, Gujarat, where farmers suffered massive crop failure due to substandard inferior quality of cotton seeds sold by a retail shop and manufactured by Pravardhan Seeds Pvt. Ltd. Despite the availability of compelling evidence, including field visits by agricultural officers, video acknowledgment by the seller, and interrogatory proceedings, the District Consumer Redressal Commission failed to deliver justice. This article critically analyzes the legal grounds, factual matrix, and judicial precedents that support the appellant's claim and underscores the need for consumer forums to uphold principles of justice, equity, and consumer rights.
