From Prescription To Prosecution: Is Justice Lost?

ABSTRACT


Pursuit of justice, like cure of diseases via drugs, knows no boundaries. Yet, the approach for holding the people responsible for endangering public health by manufacturing substandard drugs varies across nations. In this paper, the author would embark upon a study to unleash the rotten state of prosecution of the manufacturers of such sub-standard drugs in India by citing various examples and also compare the difference in such prosecution practices in India with some select jurisdictions. Finally, the paper will delve into the reasons that have motivated such low prosecution rates of drug manufacturers in the country and highlight the need for a more stringent and effective enforcement mechanism to ameliorate the lamentable situation in the country.
