Examining The Health And Educational Rights Of Children's Orphaned Following Pandemic Covid 19

ABSTRACT

The researcher set out to map the legal gap which is present within the Indian legal system which came much into the light after the Covid-19 Pandemic hit the nation and the greater number of children got Orphaned than in usual numbers. In the present study, the researcher tried to identify the issues and challenges the children who got orphaned in the Pandemic had to face due to the lack of a proper legal framework to grant them rights, and provide them with protection from the outside world. The children at the earliest needs to be placed up in a proper closer to home kind of environment, so that their development is not affected and they grow and bloom in the garden of flowers like other children with parents. It is a fact that children did face discrimination at the hands of law enforcement agencies while the implementation of several schemes as the policies made are so stringent and close bounded that does not inculcate much orphaned children under its ambit, which is a concern for the country as it is the urgent dire need that all the children belonging from any class, who got orphaned during the pandemic must be seen in the same footing within India.
