Examining The Constitutionality Of The Constitution (Schedule Caste) Order, 1950

ABSTRACT

In order to ensure fundamental freedoms and rights for Dalit people, the government of India passed “ The Constitution (Scheduled Caste) Order of 1950” (hereinafter referred as the Presidential Order of 1950). This article will argue how the same Order denied fundamental rights and freedoms to Dalit’s converted to Muslim or Christian faith. This article will also question the Constitutional validity of the Presidential Order of 1950 and Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The author will contend the need for judicial Intervention to protect the fundamental rights of converted Dalits.
