Examining The Conflict Between Industrialization and Labour Law

ABSTRACT


The 21st century is experiencing rapid industrialization with unprecedented advancement in the fields of technology, production, economic and human growth. The impact of phenomena like liberalization and globalization can be seen in the creation of an ever-increasing consumer-based economy, which has led to a huge surge in demand. It is suggested that nearly 70% of the Indian Economy is consumption-based. Amongst others, the fact that India is one of the largest markets known for its large consumer base also reflects the ever-increasing consumption around the world. In light of such high demand, it has become common to use the recent industrial progress for faster production and delivery of various goods and services. It is this industrialization that often finds itself at a crossroads with the rights and protectionsextended to the labourers. This conflict often leads to a complex and contentious relationship, especially in a country like India, where there is an excess of human resources as a result of its population. This paper aims at understanding the conflict between industrialization and labour laws, with a special focus on the new labour and industrial laws that were passed between 2019 and 2020. This paper will examine the history of industrialization, the impact of globalization, contemporary manifestations, and potential future implications. The paper will also examine the role of various stakeholders such as the governments, tech corporations, production industries, trade unions and also the society. It will also try to look into possible avenues for resolutions of challenges faced. In conclusion, the paper will aim at trying to point at the challenges that arise in striking a satisfactory balance between industrialization and protection of labour rights, underscoring the importance of addressing this conflict in contemporary society.
