Examining India's Legislative Structure For Abortion Laws: Developments, Issues, And The Future

Poorvaja G & Ms. Nidhi Kaushik, Amity Law School, Noida

ABSTRACT

In former times, there has been a lot of talk and dispute about the abortion legislation in India. In India, the Medical Termination of Pregnancy (MTP) Act was passed in 1971, and ever since, it has undergone a number of revisions. In circumstances when pregnancy presents a risk to the mother's well-being or safety or in instances of foetal anomalies, the most significant change in 2021 increased the time frame for requesting an abortion from 20 weeks to 24 weeks. For several Indian women, especially those from disadvantaged regions, easier access to secure and lawful abortions remains difficult notwithstanding these legislative protections.
