ABSTRACT
The legitimacy and finality of international arbitration hinge not only on the arbitrator’s award but on the willingness of national courts to enforce such decisions. In the Indian context, the journey from judicial skepticism to measured deference reflects an evolving commitment to global arbitration standards. This paper critically examines the enforcement framework of international arbitral awards in India, with particular emphasis on the New York Convention’s influence, domestic legislative reforms, and the judiciary's shifting approach.
Through an exploration of key Supreme Court judgments — from Renusagar to Vijay Karia — and an analysis of the Arbitration and Conciliation Act’s amendments, this study demonstrates how Indian courts have gradually aligned their interpretation and enforcement practices with international expectations. The research also identifies remaining bottlenecks and the role of the judiciary in balancing sovereign interests with commercial finality. India’s trajectory reveals both the resilience and adaptability of its legal system in navigating the complex intersection of domestic policy and global economic integration.
