ABSTRACT
This research paper evaluates the efficacy of international human rights mechanisms in combating arbitrary arrests, focusing on Article 9 of the Universal Declaration of Human Rights (UDHR) and its significance in safeguarding individual freedoms. Special emphasis is placed on the United Nations' Working Group on Arbitrary Detention to assess its role in addressing arbitrary arrests and upholding human rights globally. The study also scrutinizes the Indian perspective, examining the country's alignment with international standards and evaluating the impact of these mechanisms on its domestic policies and practices concerning arbitrary detentions. Through a comparative analysis, this research aims to provide insights into the strengths, weaknesses, and potential areas of improvement in both the global and Indian contexts. Methodologically, the paper employs a combination of literature review, case analysis, and comparative legal analysis. The findings contribute to the ongoing discourse on human rights protection and the effectiveness of international mechanisms in ensuring justice and accountability.
