ABSTRACT
Infertility is the major global reproductive issue affecting 17. 5% of the World population. This issue can be resolved by the introduction of Assisted Reproductive Technology (ART) which includes any fertility related treatments in which eggs and embryos are manipulated. Previously, India had no specific legislation regulating it. The only guidelines available were National Guidelines for Accreditation, Supervision and Regulation of ART clinics. After the recommendation of the Law Commission in its 228th report, the legislation to facilitate ART was enacted. Two new laws regulating assisted reproduction and surrogacy were passed by the Indian Parliament are The Assisted Reproductive Technology (Regulation) Act, 2021 and The Surrogacy (Regulation) Act, 2021. This paper also finds out the shortcomings of these legislations. This paper also aims to analyze the ethical and legal issues relating to the implementation of these Acts.
