Empowering Competition Enforcement: Key Provisions Of The 2023 Amendment Act

ABSTRACT

Trade practices that restrict fair competition are investigated by the Director General. The prima facie order issued by the CCI ‘triggers’ the process of investigation. The landmark Excel Corp Case dabbled upon the scope of the powers of the Director General which set a precedent over the years. The amendment that came into effect on 18th May, 2023 granted the Director General vast powers. However, the MCA, by way of notification dated 18th July 2023, further amended Section 16 of the Competition Act.
