Electoral Bond: Analysing Its Legislation & The Problem Of Transparency

ABSTRACT


The apex court of India declared the Electoral Bond Scheme unconstitutional, which regulated the funding of political parties in India in its recent judgement. This article delves into the details of the legislation of the Electoral Bond Scheme. It explores how the scheme was legislated through the Finance Act 2017 by amending different statutes of the country. This article also explores one of the problems for which the scheme was declared unconstitutional: the problem of transparency. It also evokes the debate over the voters' right to information and donors' privacy
