E Contracts: Privacy And Choice - “Click Wrap Agreements”

ABSTRACT


With emerging technology, it has paved the path to e contracts and rose debated about choice and privacy. E contracts follow the essentials of definition of contracts defined under Indian Contract Act 1872. Click wrap agreements are a part of E contract, whereby the customer is given notice about terms and conditions, following the customer agrees. The legality of smart contracts is not yet completely established in India. Click wrap agreements have to go through certain reforms to match the ongoing demands of privacy and choice.


Privacy in the 21st century has become a matter of debate .Electronic contracts and privacy is a worldwide concern now, with growing advancement of technology, there has been an increasing amount of care towards privacy of a person which Includes data, which contains pictures, demographic information of a person, browser history, location etc. Right to privacy is a fundamental right according to Article 14 of Indian Constitution1, which is being violated in the area of contracts in so many ways.
