Dowry Laws In India: The Need To Study Gender Biased Laws

ABSTRACT:

Evaluating and analysing gender skewed laws has become a separate and a novel concept for discussion - while some favour females extensively while on the other hand some showing females as only victims and some refusing to recognise gender heterogeneity. This paper is an attempt to study one such aspect namely dowry laws where presumption lies heavily against men, the same has allowed it to be misused and used for personal vengeance considering the non-bailable nature of the offence. However any law can be misused and the same can’t be a ground for striking a law which has so successfully ensured curbing the evil of dowry, and in this light this paper is an attempt to infuse gender neutrality in the said section to replace the word “wife” with “spouse” and order necessary safeguards against the misuse of it.
