Doctrine Of Separation Of Powers: Study Between Usa And India

ABSTRACT


The structure of the constitution is based on the Doctrine of Separation of Power. The power is divided among three organs of the government i.e., Legislative, Executive and Judiciary. This doctrine is still relevant in modern times and is followed by strong democracies like that of USA and India. As the functions of democracy becomes more complex, it is not surprising to see overlapping of powers between ant two organs. In this research work we discuss what exactly is the doctrine of separation of power, its relevance in modern time and find out the extent to which this doctrine is rightly implemented in USA and India.
