Dispute Resolution Between Management And Union In Labour Disputes: Assessing The Role Of ADR

Shivam Swaroop Mathur, BBA LLB, Symbiosis Law School, Nagpur, Symbiosis International University

ABSTRACT

This study examines how well Alternative Dispute Resolution (ADR) works in India to settle labour conflicts. Even while they work, traditional litigation techniques can be expensive and strain relationships. ADR, which includes conciliation, mediation, and arbitration, provides a possible resolution. However, their effectiveness in labour disputes has yet to be studied. By reviewing scholarly articles, legal provisions, and cases about alternative dispute resolution (ADR) in labour disputes, this study seeks to close this gap. The objective is to weigh the benefits and drawbacks of alternative dispute resolution (ADR) methods to provide recommendations for improving ADR's involvement in labour conflicts. This research advances our knowledge of the usefulness of ADR in labour disputes.
