ABSTRACT
The research examines the prevalence of health-based discrimination against workers, focusing on the Indian legal framework. It highlights that employees with chronic illnesses, disabilities, or mental health conditions often face unjust treatment, including denial of employment, unequal pay, lack of job security, and limited advancement opportunities. Indian labor laws, such as Right to Equality and Persons with Disabilities Act, provide foundational protections, but gaps remain in enforcement and coverage. Employers frequently neglect reasonable accommodation, exacerbating marginalization, particularly in informal sectors. The research also references critical rulings which emphasize the judiciary's role in interpreting these protections inclusively. Despite legislative advancements, the research argues for comprehensive legal reforms and cultural shifts to eliminate workplace biases and support equitable employment practices. It calls for enhanced awareness, better enforcement, and the development of an inclusive policy framework to ensure that workers with health conditions are treated fairly and can fully participate in the workforce.
