Delegated Legislation And Its Growth In India

Priyesh Ahirwar, BBA.LLB (Hons.), Jagran Lakecity University Bhopal

ABSTRACT

Delegated Legislation, also known as Subordinate Legislation, has become an inextricable element of administration. Modern governments appear to be depending more and more on the rulemaking power bestowed upon them to speed up decision-making and avoid the time constraints that plague the old legal system. Despite its widespread acceptance and widespread use now, this system did not always hold such a position. Delegated Legislations have evolved throughout the years, raising doubts about their validity and legitimacy. These issues have arisen in the context of both the idea of separation of powers and the issue of excessive governmental power or abuse of power.

The purpose of this research is to investigate the history, evolution, and current condition of delegated legislation in India.
