Delay In Execution Of Death Penalty: Affecting Mental Health And Causing Ambiguity In Life Of Convicts

Vaishnavi Singh, Symbiosis Law School, Noida

ABSTRACT

The delay in the execution of the death penalty has been a controversial and widely debated topic globally. This paper explores the impact of prolonged delays in the execution of the death penalty on the mental health of convicts, as well as the ambiguity it creates in their lives. It discusses the legal framework surrounding capital punishment in India, highlighting the rarest of rare doctrine and the safeguards in place to prevent wrongful executions. Despite the rarity of death penalty pronouncements, there is a significant backlog in executions, leading to mental health issues among convicts and causing a practical double jeopardy.
