ABSTRACT


The Supreme Court in the case of Abhishek Upadhyay v. the state of Uttar Pradesh and anr. reiterated journalistic freedom in India. The case involved journalist Abhishek Upadhyaya, who was faced an FIR for publishing an article with casteist tilt on the officers deployed in the state. He filed a writ petition alleging that the charges violated his right to freedom of speech under Article 19(1)(a). The Supreme Court's decision in favor of Upadhyay highlights the importance of freedom of the media and the need to protect journalists from arbitrary state action. This decision not only addresses immediate concerns, but it also sets an important precedent that encourages fearless reporting and promotes transparency and accountability in government.
