ABSTRACT

This research paper offers a comprehensive analysis of capital punishment also known as death penalty. It traces the historical evolution across the globe, legal framework, constitutional validity, deterrent efficiency and human rights implications of the death penalty. The paper delves into the intricacies of the legal framework that governs death penalty, shedding light on the key legislative aspects.

The research highlights the constitutional validity of the death penalty in the context of evolving societal norms and human rights standards. The study examines the debated deterrent effect of capital punishment and the role of mercy petition in sentencing. The research also delves into the application of rarest of the rare doctrine and addresses the public opinion on capital punishment discourse and assesses human rights implications on death row convicts.

By synthesising these multifaceted aspects, the research contributes to the holistic understanding of capital punishment that remains a contentious topic of debate within the domains of law, ethics and human rights.
