Death Penalty And Its Existence In Indian Society: A Critical Analysis

ABSTRACT

India is a country that is experiencing significant development, but it is also facing an increase in crime rates. Despite having various laws to control and prevent crime, the punishment given to criminals is not sufficient, resulting in an increase in crime rates. To reduce crime rates, the punishment for wrongdoing needs to be severe. There are different types of punishments in India, including capital punishment, life imprisonment, and imprisonment, all aimed at penalizing the offender. Capital punishment is considered the most severe form of punishment. This paper discusses the global status of capital punishment, the concept of capital offenses, and the various modes of capital punishment in India. Additionally, the article delves into two major theories related to capital punishment, namely the reformative and preventive theories. The research also explains the rarest of rare cases and discusses the history of capital punishment in ancient India. This article provides a comprehensive overview of capital punishment in India, including the various methods of execution used in the country.
