Data Monopolies In India: Assessing Market Power, Regulation, And Collusion

ABSTRACT


In the digital age, data has become a valuable asset, and companies harness vast amounts of data to gain a competitive edge. However, this trend has led to the emergence of data monopolies, where a few dominant entities control the majority of critical data resources. This paper examines the implications of data monopolies in India, focusing on market power and the regulatory response of the competition law framework in India. Additionally, this paper investigates how algorithms and machine learning, often employed by these dominant entities, can facilitate collusion among competitors and explores the legal challenges in detecting and preventing such behavior in the Indian market.
