Ishita Garg, Jindal Global Law School

ABSTRACT

The matter of indecency has always been a convoluted one, as it encompasses other interconnected matters such as decency and ethical values. However, this intricate matter of indecency, when it falls within the purview of the virtual realm, poses a menace to internet users due to its boundless nature and the presence of anonymous individuals. In this era of digitalization, an enduring reality or transgression of cyber obscenity will always assert itself in the domain of the online space. The proliferation of these networks and the progressions in networking architecture have heightened this transgression among adolescents. Cyber obscenity poses a threat to internet users worldwide, as there are no territorial boundaries that differentiate the perpetration of this offence between nations. Nowadays, cyberpornography has emerged as a substantial industry. This paper will study the legal aspect of cyber obscenity and pornography, its concept and test, with a prime focus on the present scenario. The focus of this research paper is to examine how obscenity and pornography foster peer pressure among adolescents, potentially leading them to engage in unlawful activities. The paper endeavours to evaluate the legislation governing obscenity in India and proposes reasonable suggestions.
