Curiosity Or Crime? Investigating Voyeurism’s Shift To The Cyber Realm

ABSTRACT:


In this new age of internet and technology things are changing and evolving at a greater length. The advent of internet alongwith the rise of technology gave birth to thousands of possibilities. Anything that seemed to be impossible some years back like processing large amount of data or searching for any piece of information which is not available in a particular place or is unavailable with any organization all this work can be done within a very less amount of time. And, all of this has been possible because of the sudden rise of technology and its usage in the most productive way possible. However, due to this sudden rise in technology there are certain problems as well which have increased such as the rise in the crime rate. Today the maximum number of crimes committed involve some kind of electronic device or the use of technology in one form or the other. One of the crimes which we will be discussing in this paper is voyeurism. Voyeurism is an act which involves a person spying on any other person in any place when he/she has the reason to believe of being alone when the person is involved in any kind of act which involves the private parts of a person being exposed and the other person watches it for sexual gratification or for recording the said act and publishing or transmitting the video on internet to harass the victim. As the paper proceeds, we will be discussing various tools used by a voyeur to commit such offence, what are the challenges faced in conducting an investigation of voyeurism as cybercrime, the remedies provided by the justice system to the victim and the laws related to voyeurism as cybercrime to punish the perpetrator in India alongwith what changes are needed to strengthen the laws of the crime.
