ABSTRACT


In an era characterized by the rapid digitization of cultural artifacts and the globalization of knowledge, the intersection of cultural heritage preservation and intellectual property has become an increasingly complex and critical issue. This abstract provides a glimpse into the multifaceted dynamics explored in the full work.


This research delves into the intricate relationship between intellectual property and the preservation of cultural heritage. It scrutinizes the implications of copyright laws, patent protections, and trademark rights on the safeguarding of historical artifacts, architectural treasures, artworks, ancient texts, and indigenous cultural knowledge. It investigates how copyright restrictions, moral rights, and the emergence of orphan works affect the digitization and dissemination of cultural materials.


The study scrutinizes the challenges and opportunities presented by the digital age, where 3D scanning and printing technologies allow for the replication of cultural items while raising questions about authenticity and ownership. It highlights the ethical concerns surrounding the repatriation of cultural artifacts and the duty to respect indigenous intellectual property rights.


Additionally, the paper explores international agreements and conventions that guide the protection and preservation of cultural heritage, emphasizing the role of organizations like UNESCO in setting global standards. It also investigates the importance of open access and public engagement strategies to ensure that cultural heritage remains accessible to all, while striking a balance with IP rights.
