Cross-Border Insolvency And E-Commerce Transactions: Navigating Private International Law

Indrajeet K Singh, KIIT School of Law

ABSTRACT

The article delves into the complexities of navigating cross-border insolvency and e-commerce transactions through the lens of Private International Law (PIL). It primarily focuses on the intricacies involved in handling insolvency cases that span multiple jurisdictions, a situation increasingly common in the digital age where e-commerce activities extend across borders. The UNCITRAL Model Law on Cross-Border Insolvency serves as the central framework for discussion, providing a harmonized approach to dealing with such insolvencies by emphasizing key aspects like access, recognition, relief, and cooperation among involved jurisdictions. This legal framework aims to offer solutions to the challenges posed by the global nature of e-commerce transactions and their insolvency proceedings, highlighting the importance of international legal cooperation and harmonization.
