ABSTRACT
Evidence is an indispensable part of any trial whether civil or criminal, as it testifies the facts. These facts in turn, are used as evidence helping to decide, or to win the facts in disputes. Evidence carries weight and helps in strengthening the facts which are produced as evidence. It is a crucial factor, and in several scenarios evidences can completely overturn the direction of the case. One of the most integral part of the Indian judiciary is based upon the presumption that the accused is innocent until and unless, his guilt is proved beyond reasonable doubt. It is usually said that, it is better that ten guilty are held free, rather than one being falsely framed for a case. The onus of proof in a criminal proceeding is extremely high.
Circumstantial evidence holds an important position in civil and criminal proceedings. It is presented by means of relying on the fact in issue or other relevant facts, which may serve to be incompatible with any other result other than the principal fact in issue. The entire analysis takes us back to the single most imperative question which is, “Whether or not circumstantial evidence can be solely used as a basis of conviction or not?” Talking about criminal cases, circumstantial evidence has played a pivotal role in assisting the Courts to administer justice in numerous circumstances. The current research paper focuses on discussing some of the murder cases that have been decided by the Supreme Court of India, which are solely based on circumstantial evidence, along with its relevance and significance in each of the mentioned cases.
