Critical Analysis On Lifting Of The Corporate Veil By Judicial Interpretation

ABSTRACT

The paper Critically Analyses the lifting of Corporate Veil by Judicial Interpretation. The aim is to give readers an understanding on how Corporate Veil is lifted by the Courts in various situations, mainly focusing on situations of Fraudulent or improper conduct, Tax Evasion, Public Policy and Single Economic Entity where Corporate Veil is lifted. In certain cases, it is a boon while in others it is a bane. The discussion of this Research Paper hence revolves around the fact that even though we need Judicial Interpretation for lifting of the Corporate Veil, it has to be more expansive with definite principles along with a regulatory framework as the law is evolving. Therefore, even though I agree that we should give the Courts the freedom to interpret the law, such freedom must be limited, or it can be misused.
