Introduction


In present world, where the cases of undue influence are increasing rapidly it is important to understand what actually is undue influence. Undue influence occurs when one person is in a position to persuade the decision of others because of the relation they are in. section 16 of the contract act talks about undue influence. According to it, a contract entered because of undue influence is a void agreement and has no value in the eyes of law. Undue influence occurs mainly when one party which is stronger is able to influence the weaker party for his own desired outcome. Undue influence is based on the principles of equity. The purpose of the study is to understand the concept of undue influence and various types of undue influence. As there is an increase in the cases of undue influence it is important to understand as to why there is an increase in the cases? What type of undue influence is it and how can it be avoided?
