Critical Analysis Of The Relationship Between Police And Human Rights

ABSTRACT

The most curious function of the legal framework agency is to protect and promotes the basic rights of humans. The criminal justice system of India includes police which play a vital role in the protection of the human rights. But there have been numerous instances of abuse of power officially as well as unofficially by police. The ardent example of abuse of power by police officials is harassing the innocent on grounds of suspicion. Many times the violations of human rights by police officers start from arrest procedure only. There are various convention and lots of provisions in the Indian legislation which talks about the protection of the human rights. After 1861 Police Act lots of amendment was suggestion by various commissions and committee but hardly of them got implemented. Considering the significant role that police could play in the promotion and protection of human rights, a subtle attempt is made in this paper to study the concept of human rights, powers of police, relationship between human rights and police through various international and national legal instruments and judicial approach and verdicts of the courts.
