Critical Analysis Of The Fair Dealing In Copyright

ABSTRACT

Intellectual property Laws are designed to encourage Creativity and to protect Creative works. copyright Act intends to encourage the creators to create works. The Doctrine of fair dealing is an important part of the copyright act. The copyright act grants an exclusive right to the owner of creative work. However, this exclusive right over creative works of the copyright owners is restricted by the ‘doctrine of fair dealing’. Section 52 (1) (a) of the copyright act provides legal Provisions as to Fair dealing. A similar concept of ‘fair use is a part of American copyright law, which is fairly similar to our concept of fair dealing, but there is a difference between the two too. This paper attempt to delve deeper into the meaning and concept of fair dealing and Analysis of the recent Delhi University photocopy Judgement and the scope of its application in India.
