A Critical Analysis “The Occupational Safety, Health And Working Conditions Code, 2020”

ABSTRACT


This research paper aims to put forth a detailed analysis of the newest labour code, i.e., The Occupational Safety, Health and Working Conditions Code, 2020. This was a tectonic shift in the domain of labor law and definitions therein. The OSH Code, 2020 isn’t merely a compilation of the previously existing 13 laws; rather, substantial changes were made in the draft to eradicate the ever worsening working conditions of workers and to promote ease of doing business of the employer. In the later part of the paper, the newest insertions are being discussed in detail. The multiplicity of legislation has been a primary reason for ambiguity among both employer and employees, and at certain parts, provisions were repetitive and oxymoronic. All the prior legislations weren’t merely retrenched but reconstructed ab-initio. The definitions under the code were widened, new authorities were established, and most importantly, penalties and offenses were redefined. This paper includes inter-alia, background, key highlights of the code, a detailed dissection of the new provisions, and the objective of the code. As of now, the code seems pretty inclusive and sophisticated in terms of definition and uphold labour rights to a greater extent.
