ABSTRACT:
Our society's corruption is comparable to cancer in that if it is not caught early enough, it will spread rapidly across the democratic system. It threatens constitutional government and upends the foundations of democracy and the Rule of Law. Corruption detection has long been a major issue. Every state in India has a court where judges are seated to administer justice to those who seek it without fear or intimidation. Many nations have discovered the fight against corruption will be extremely difficult. This is because corruption is so pervasive, civic societies over the world have accepted it and don't mind engaging in it. Both inside and outside of the court system, there are those who are accountable for the corruption. On the one hand, the judicial officers—judges, attorneys, prosecutors, and court staffs—play an important part. Low compensation, avarice, and a lack of oversight are determined to be the main drivers of their participation. Judges engage in corruption through meddling mostly in the hiring and decision-making processes, while other court personnel engage in a variety of corrupt practises, starting with witness tampering. On the other hand, the average person typically engages in corrupt activities in order to obtain quick and favourable choices. There are many different ways that corruption is used. However, in India, it primarily refers to either bribery or political meddling on the part of the executive or bureaucracy. Democracy will fail if these practises are allowed to continue. Additionally, the public's faith in the administration of justice will be destroyed. Why do people engage in corruption, what motivates them to do so, and what are the effects of such behaviour? These are the research topics that need to be addressed and answered for such conduct, in addition to what could be done to avert the issue from occurring. The issue is that some judges have consented to abuse the authority entrusted to them in the temple of justice because they lack accountability and deliver decisions while being swayed by politicians, bureaucrats, etc. by accepting sizable bribes through illegal means, which has led to the corruption of the judicial system. Judges are subject to the impeachment procedure, which the Indian Constitution prohibits.
