Corporate Layoffs And Their Relevance In Labour Law

Harshvi Trivedi, K.E.S Jayantilal Patel Law College

1] ABSTRACT:

Corporate layoffs, often employed as a cost-reduction strategy during economic downturns or organizational restructuring, have become a significant concern for both employees and legal systems worldwide. Labour law, designed to protect the rights of workers, plays a crucial role in regulating such layoffs, ensuring procedural fairness, and safeguarding the interests of both employees and employers. This research paper critically examines the relevance of corporate layoffs within the framework of labour law, focusing on how different jurisdictions balance the need for businesses to downsize with the legal protections afforded to employees. Key legal aspects such as severance pay, redundancy procedures, collective bargaining, and the socio-economic impact of layoffs are explored. Furthermore, the paper discusses evolving labour law trends, particularly in light of globalization, automation, and economic crises, and proposes necessary reforms to better address the challenges posed by mass layoffs.
