Corporate Criminal Liability: An Indian Perspective

ABSTRACT


The supreme Court of India made it clear and obvious by pronouncing the judgment on the issue of CCL in India that a criminal charge can be brought against a corporation as a distinct legal body even in the offenses where the prescribed punishment is imprisonment. In this paper the researcher will try to describe the current standing of India on CCL and how the decisions made by Courts of India is contradictory with the provisions of statute. Further the paper will analysis in detail the international framework on the topic of CCL. The order passed by the Apex Court of India on different issues, mirrors the gravity of the concerned issue, which is being faced by the aggrieved parties. The doctrine of “No Soul to Kick” has become outdated as another doctrine “Lifting of Corporate Veil” gained much significance relevance in this regard, has opened the sheath. The research papers regarding the matter of Corporate Criminal Liability have been incorporated and it is validated with the impact of current SC’s Judgment along with focused on the dilemmatic circumstances came into existence as a result of such judgment.
